Terms and Conditions for The Origami Bakery

Welcome to The Origami Bakery, a cottage food operation based in Austin, Texas, operating under Texas cottage food laws (Texas Health and Safety Code, Chapter 437). By placing an order with us, you agree to the following Terms and Conditions. Please read them carefully.

1. General Information

• Business Nature: The Origami Bakery is a home-based cottage food business producing non-time/temperature control for safety (non-TCS) foods in compliance with Texas Department of State Health Services (DSHS) regulations.

• Sales: Products are sold directly to consumers for personal consumption via in-person pickup, delivery within Austin, or at approved venues like farmers’ markets. No online sales with shipping or third-party delivery services are offered.

2. Ordering Process

• Order Placement: Orders must be placed via The Origami Bakery website during the designated order window: Sunday 8 AM-Thursday 8 AM (local Central Time). Custom orders require confirmation of availability.

• Availability: Products are subject to availability. We reserve the right to refuse orders due to capacity constraints or ingredient shortages.

• Confirmation: Orders are confirmed via email. You will receive an order summary, including pickup/delivery details and total cost.

3. Pricing and Payment

• Pricing: Prices are listed on our website and subject to change without notice. All prices include applicable sales tax per Texas law.

• Payment: Payment is due at order placement. We accept any form of online payment supported by Stripe. No refunds for completed orders unless otherwise stated.

• Late Payments: For custom orders, failure to pay by the agreed deadline may result in order cancellation without refund of any deposit.

4. Pickup and Delivery

• Delivery: Local delivery within Austin's 78731 zip code is available for no fee until July 12th, 2025. Delivery times are approximate and subject to change.

• Responsibility: Customers must verify order accuracy upon receipt. We are not responsible for products after they are picked up or delivered.

5. Cancellations and Refunds

• Cancellations: Orders may be canceled with 24 hours notice before pickup/delivery for a full refund. Due to preparation costs, late cancellations will not be accepted.

• Refunds: Refunds are issued only for cancellations meeting the above criteria or if we cannot fulfill the order. No refunds for customer dissatisfaction after product acceptance.

• Custom Orders: Deposits for custom orders are non-refundable unless we cancel the order.

6. Allergen and Safety Information

• Home Kitchen: Products are made in a home kitchen not inspected by DSHS or local health departments, per Texas cottage food law. Our kitchen may contain allergens, including wheat, dairy, eggs, nuts, and soy.

• Customer Responsibility: Customers must inform us of any allergies when ordering. We are not liable for allergic reactions or health issues from consumption.

• Labeling: All products are labeled with ingredients, our name, address, and the statement “Made in a home kitchen” as required by Texas law.

7. Liability

• Limitation of Liability: The Origami Bakery is not liable for damages, injuries, or illnesses resulting from product consumption, except as required by law. Customers assume responsibility for proper storage and handling after receipt.

• Events: For products served at events, customers must ensure safe storage and compliance with event venue rules.

• Insurance: We carry general and product liability insurance to cover unforeseen incidents, but this does not extend to customer negligence.

8. Customer Conduct

• Respectful Interaction: We reserve the right to refuse service to customers who engage in abusive or inappropriate behavior.

• Compliance: Customers must comply with pickup/delivery instructions and Texas cottage food purchasing restrictions (direct-to-consumer only).

9. Intellectual Property

• Designs: Custom designs (e.g. logo and photos) remain the intellectual property of The Origami Bakery. Photos of our products may be used for promotional purposes unless you request otherwise.

10. Changes to Terms

• We reserve the right to update these Terms and Conditions at any time. Updated terms will be posted on our website and apply to all orders placed after the effective date.

11. Governing Law

• These Terms are governed by the laws of the State of Texas. Any disputes will be resolved in Austin, Texas courts.
